Terms and Conditions
The following provisions are designed to protect the
customer and KK ELSEWHERE. The services provided and the respective
responsibilities and liabilities are outlined and governed by these TERMS AND
CONDITIONS; it is the customer's responsibility to carefully read and
understand them. Procedures for payment, changes, cancellation, and charges are
specified herein. In many cases, fees for changes and cancellations reflect
fees assessed by vendors providing elements of the Packages. Amendment fees may
apply if changes are required to packages.
1.
Tour Fare Includes:
(1)
Traveling Expenses:
Fairs for air, train, and motor coach travel specified in the itinerary.
(2)
Accommodations:
Accommodation charges, including taxes and service charges, specified in the
itinerary.
(3)
Meals: Meals
specified in the itinerary
(4)
Admission Fees:
Admission fees for attractions specified in the itinerary
(5)
Miscellaneous Expenses:
Tolls, parking fees, and other expenses including tips related to group
transportation.

Planning Fee
(7)
Handing Fee
(8) Conductor Service (Traveling expenses, accommodations for tour conductor if required)
(9) Consumption Tax and Other Taxes (related to the above items)
2.
Tour Fare Does Not Include:
Items not mentioned in Article #‚P are not included in the tour fare. These items include but
are not limited to:
(1)
Costs incurred for activities not
mentioned in the itinerary.
(2)
Personal expenses such as
telephone charges, laundry charges, Internet, sundry and additional meals and drinks.
(3)
Surcharges for excess baggage
(4)
Courier/cargo services (takkyubin, personal freight)
(5)
Lift tickets (unless specified)
(6)
Insurance
(7)
Equipment rentals
(8)
Guided tours (unless specified)
Please note refunds will not be issued on unused
vouchers for transfers, day tours or ski passes.
3.
Acceptance of Planned Itinerary
and Payment
(1)
Please advise ELSEWHERE of either
your acceptance or non-acceptance for the planned itinerary by the specified
confirmation booking date.
(2)
If ELSEWHERE does not receive any
contact from you by the specified date, ELSEWHERE will assume your
non-acceptance for the planned itinerary and consider that the contract has
been cancelled by you.
(3)
Payment for bookings are required
as specified at the time of the booking. Bookings accepted closer to the
arrival date require full payment within the period specified upon confirmation
of the reservation. Payments not received by the due date will be cancelled
immediately.
(4)
Please make sure when
International bank transfers are performed to specify that bank's charges are
to be paid by the sender, these are known as gCorrespondent chargesh All bank
transfer fees must be paid separately to the reservation cost and this is
responsibility of the customer.
(5)
All prices are quoted in both USD and
\ and all packages must be paid for in USD or \. Package prices are subject to
change without notice. Upon receipt of payment within the specified time
periods, package pricing is guaranteed. Additional costs caused by factors
beyond our and our package providers control are unrecoverable.
4.
Alteration of Tour Fare For Changes To Contract Details or Number of Participants.
Depending on the type of package sold payments should
be made as early as possible to avoid loss of booking and cancellation. All
bookings are subject to availability at the time of reservation.

If ELSEWHERE receives notice of
changes in the details of the contract or number of participants, ELSEWHERE
will make the changes necessary to meet your requirement to the best of our
abilities, ELSEWHERE reserves the right to amend within reasonable notice the
tour fare and schedule if such a change is necessary. With regards to final
payments this will vary depending on the type of package booked as well as the
period booked. All prices and services specified in this web site are subject
to change without notice.
(2)
If changes are made after your
acceptance of our itinerary and confirmation, you will required to pay any
cancellation fees or breach of contract fees for transportation or
accommodations, as well as service fees as follows;

If you change the number of
participants after your acceptance of our itinerary and confirmation, you will
be required to pay a cancellation charge for the reduced number of
participants. Cancellation charges will be calculated based on the terms and
conditions set below.
(4)
If fares require revision,
ELSEWHERE will increase or decrease fares specified for the base day in the
written plan. ELSEWHERE will notify you of any increases no later than 15 days
before the departure day. If there is an increase in the tour fare, you can
cancel the tour contract without paying any cancellation charges.
(5)
If there is a decrease in fares,
ELSEWHERE will deduct the difference from the tour fare in an amount equal to
the difference between the revised fare and original fare.
5.
Cancellation of the Tour Contract
or Partial Cancellation of Tour Contract Due To Reduced Number of Participants.
(1)
If you cancel the tour contract or
decrease the number of participants, you will be required to pay following

(2)
Charges for the chartered vessels
will be based on our general contractual conditions.
(3)
If you do not pay the tour fare by
the specified day, it will be assumed that you have cancelled the tour contract
on the next calendar day and you will be required to pay breach of contract
fees equivalent to the cancellation charges.
6.
Travel Documents
Only upon receipt of full payment, travel documents
are delivered by mail, faxed, emailed or collected at the destination specified
by Elsewhere. Packages booked through agents outside
7. Responsibility
and Liability
All winter recreational sports including skiing and
snowboarding involve inherent risks about which the customer must make himself or herself aware of. By participating in an ELSEWHERE
excursion, the customer does hereby agree that neither the customer nor
associated parties claim for illness, injury or death resulting from the
negligence (but not the willful or fraudulent conduct) of ELSEWHERE, or
affiliated organizations or the supplier of any element of the Package
(hereinafter referred to as the gSuppliersh as a result of the customer's
participation in the Package. Suppliers, including but not limited to those
arranging for or providing air and ground transportation, sightseeing
arrangements, ski and snowboard rentals, and Lodging, are independent
contractors and are not employees of ELSEWHERE. All travel documents are issued
subject to Suppliers' terms and conditions. Neither ELSEWHERE nor the Suppliers
for which ELSEWHERE acts as agent(s), shall be held liable for, and customer
waives any claim against, ELSEWHERE and the Suppliers for loss or damage to
property, or injury to person caused by reason of any failure of performance,
defect, negligence, or other wrongful act or omission. ELSEWHERE and it's
agents act only in the capacity of agents for the customer on all matters pertaining
to Lodging, activities, and transportation whether by air, rail, bus,
automobile or otherwise and as such ELSEWHERE and its agents shall not be
liable for any injury, damage, loss, accident, delays, or any other
irregularity which may be occasioned whether by reason of any Supplier or
otherwise in connection therewith. The passenger contract in use by the airline
and/or any other Supplier hereunder shall constitute the sole contract between
the respective company and the customer and/or purchaser of the Package.
